What the site is, and what a reservation through it means

Terms that say plainly whose contract binds you when you reserve

These terms cover using this site and asking this office to place a reservation. They are short because this office does little: it arranges, and another company performs. The contract that binds you is that other company's, and these terms say so rather than implying it.

Who these terms are between

Orchard and Oar Bookings LLC, which operates under the name Orchard and Oar, and you. The office is a Florida limited liability company with its office at the address printed at the foot of every page of this site.

What happens at this desk

It arranges reservations with companies that operate trips. It does not operate any trip, provide any accommodation, carry anybody anywhere, or hold client money. It arranges no carriage by air or by sea and it holds a contract with no carrier.

Our part and their part

Ours is to describe departures accurately, to put your dates to the operating company, to give you that company's figure and terms in writing before you agree to anything, and to place the reservation as instructed.

Theirs is everything that happens on the trip: the accommodation, the transport, the guides, the safety of it and the liability for it. Their contract governs your booking, including cancellation, changes and what happens if a service is not provided.

Payment, refunds and delivery

No payment is taken by this office, so no refund can arise from it. Every invoice, receipt and refund is a matter between you and the operating company under its terms.

Nothing physical is sold or shipped from this site. Confirmations and documents come to you electronically from the operating company. There is no returns process here because there is nothing here to return.

Accuracy, and where it ends

Figures on this site are starting figures quoted by operating companies and they change. Seasons shift, operators withdraw departures, and a price confirmed against your dates is the only price that means anything. Nothing on this site is an offer capable of acceptance.

Nothing here is a promise about weather, wildlife, water levels, light or anything else outside human control.

What is not offered at all

Insurance of any kind. Advice on visas, passports, immigration, vaccination, health, law or finance. Currency exchange, lending or any financial product.

Governing law

The law of the State of Florida governs these terms and any dispute arising from them.

Revising these terms

Revisions happen. Whatever stands on this page at the hour you write in is the version your request falls under.
